Terms of Service

Welcome to PurnOrganic. These Terms of Service ("Terms") govern your access to and use of the PurnOrganic platform, including our website at www.purnorganic.com, mobile applications, and all related services (collectively, the "Platform"). By registering, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About PurnOrganic

PurnOrganic is a technology-enabled multi-sided marketplace that connects buyers with certified organic farmers, producers, and suppliers across India. PurnOrganic acts as an intermediary platform facilitating transactions between buyers and sellers; it is not the seller or manufacturer of any listed product unless explicitly stated.

2. User Eligibility

  • You must be at least 18 years of age to register and transact on the Platform.
  • Sellers, suppliers, and B2B partners must be legally constituted entities or adult individuals capable of entering into binding contracts under applicable Indian law.
  • PurnOrganic reserves the right to refuse registration or revoke access at its sole discretion.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate, complete, and current information during registration and to update it as necessary.
  • You are liable for all activities that occur under your account. Notify us immediately of any unauthorised use at support@purnorganic.com.
  • PurnOrganic may suspend or terminate accounts found to be in violation of these Terms.

4. Orders, Fulfilment & Delivery

  • All orders placed on the Platform are subject to availability and seller confirmation.
  • Estimated delivery timelines are indicative and may vary based on location, product type, and logistics partner capacity.
  • Risk of loss and title for purchased items passes to the buyer upon delivery to the carrier.
  • PurnOrganic coordinates logistics but is not itself a logistics provider. Delays caused by third-party couriers are outside our direct control.
  • Buyers must inspect goods at the time of delivery and raise any quality concerns within the stipulated timeframe.

5. Pricing, Taxes & Billing

  • All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.
  • Prices may vary and are set by individual sellers. PurnOrganic does not guarantee the lowest price.
  • Invoices and GST receipts are generated and provided by the respective seller/supplier.
  • PurnOrganic reserves the right to correct pricing errors before order confirmation.

6. Payments & Payment Processing

  • Payments are processed through secure, PCI-DSS compliant third-party payment gateways.
  • Accepted payment methods include credit/debit cards, UPI, net banking, and wallets as displayed at checkout.
  • PurnOrganic does not store full card details. Payment data is handled entirely by the payment gateway.
  • In case of a failed or disputed transaction, please contact our support team with your transaction reference number.

7. Settlement & Supplier Payouts

  • Seller and supplier payouts are processed on a T+0 settlement cycle (same business day) unless otherwise agreed in writing.
  • Payouts are subject to deduction of applicable platform fees, commissions, and any outstanding dues.
  • Disputed amounts may be withheld pending resolution of the relevant claim.
  • Detailed payout statements are accessible via the seller/supplier dashboard.

8. Returns, Refunds & Cancellations

Returns, refunds, and cancellations are governed by our separate Refund, Return & Cancellation Policy, which forms part of these Terms. Key points:

  • Orders may be cancelled within 2 hours of placement, or before dispatch, whichever is earlier.
  • Returns are accepted only for damaged, defective, or significantly wrong items reported within 24 hours of delivery.
  • Perishable products (fresh produce, dairy) are generally non-returnable once delivered.
  • Approved refunds are processed within 7–14 business days to the original payment method.

9. Prohibited Activities

You agree not to:

  • List, sell, or purchase products that are illegal, adulterated, or falsely labelled as organic
  • Use the Platform for any fraudulent, deceptive, or unlawful purpose
  • Manipulate reviews, ratings, or pricing algorithms
  • Scrape, crawl, or extract data from the Platform without written authorisation
  • Introduce malware, viruses, or any harmful code
  • Impersonate another user, seller, or PurnOrganic representative
  • Engage in any activity that disrupts, damages, or impairs the Platform
  • Circumvent the Platform by conducting off-platform transactions with users you first contacted through the Platform

10. Intellectual Property Rights

All content on the Platform — including the PurnOrganic name, logo, design, text, images, software, and data compilations — is the intellectual property of PurnOrganic or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

By submitting content (product images, descriptions, reviews) to the Platform, you grant PurnOrganic a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such content in connection with operating the Platform.

11. Product Quality & Disclaimer

PurnOrganic endeavours to ensure that only genuine, certified organic products are listed on the Platform. However, PurnOrganic does not independently verify every product claim and disclaims liability for any inaccuracy in product descriptions provided by sellers/suppliers. Buyers are encouraged to review product labels, certifications, and reviews before purchasing.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • PurnOrganic's total liability for any claim arising out of or relating to the Platform shall not exceed the amount paid by you for the relevant transaction.
  • PurnOrganic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
  • PurnOrganic is not liable for the acts or omissions of third-party sellers, suppliers, logistics providers, or payment gateways.

13. Indemnity

You agree to indemnify, defend, and hold harmless PurnOrganic and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit to the Platform.

14. Force Majeure

PurnOrganic shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, war, civil unrest, government actions, internet outages, or strikes.

15. Suspension & Termination

  • PurnOrganic may suspend or terminate your account or access to the Platform at any time, with or without notice, for violation of these Terms or for any other reason at its sole discretion.
  • You may close your account by contacting support. Closure does not relieve you of obligations for prior transactions.
  • Upon termination, your right to use the Platform ceases immediately. Data may be retained as required by law.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India. We encourage you to first attempt to resolve any dispute through our customer support team.

17. Changes to Terms

PurnOrganic reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 7 days before taking effect. Continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
